- Decided

Holding
A petitioner who is merely a complainant and not an aggrieved party lacks locus standi, rendering the writ petition non‑maintainable.
Summary
The petitioner, Prabhat Yadav, filed a writ petition seeking a direction to the State respondent No.3 to address his grievance and decide on his complaint letters dated 06.07.2026 and 07.07.2026. The respondents argued that the petitioner, being only a complainant and not an aggrieved party, lacked locus standi to file the petition. The Court examined the claim of maintainability and held that a mere complainant without a direct legal right or injury cannot invoke the jurisdiction of the High Court. Consequently, the petition was found to be non‑maintainable. The Court dismissed the writ petition on the ground of lack of locus standi.

HON'BLE MRS. MANJU RANI CHAUHAN, J.
Heard learned counsel for the petitioner, learned Standing Counsel for the
State-respondents, Mr. Avneesh Tripathi, learned counsel for the
respondent nos.2&3 and perused the records.
The present writ petition has been filed with a prayer to direct respondent
No. 3 to address the petitioner's grievance and take a decision on the
petitioner's complaint letter/representation dated 06.07.2026 and
07.07.2026.
At the very outset, Mr. Avneesh Tripathi, learned counsel for the
respondent nos.2&3 submits that the present petition, filed at the behest of
the petitioner, is not maintainable, as the petitioner is merely a
complainant and has no locus standi, not being an aggrieved party.
In view of the above, the petitioner being complainant has no locus to file
the petition.
Accordingly, the writ petition is dismissed as not maintainable.
