Allahabad High Court

ARUN KUMAR PREMIversusSTATE OF U.P. AND 5 OTHERS

Decided

Holding

The petition is disposed of with a direction to the respondent authority to decide the petitioner’s pending representation within twelve weeks, without adjudicating the merits of the promotion claim.

Summary

The petitioner, Arun Kumar Premi, filed a writ petition seeking mandatory orders for his promotion to Administrative Officer (due since 09-10-2019) and Senior Administrative Officer (due on 29-01-2026) along with all related service benefits. He also requested the court to direct the respondents to decide his pending representation dated 05-01-2023 within a stipulated period. The respondents argued that the petition should not be kept pending and that the representation should be decided promptly. The court, without expressing any view on the merits of the promotion claim, disposed of the petition by directing the respondent authority to decide the representation expeditiously, preferably within twelve weeks of the order, after giving a hearing. The order thus provides a procedural direction but does not grant the promotion relief sought.
