Holding
The Court dismissed the writ petition and directed the petitioners to make fresh representations before the respondent, after which the matter will be decided in accordance with law.
Summary
The petitioners, fourteen teachers serving as In‑charge Headmasters, filed a writ petition seeking a mandamus directing the State to pay them the salary and benefits of a Headmaster, relying on a Government Order dated 16‑07‑2026. They alleged that despite multiple representations to the competent authority, no decision had been taken. The respondents argued that the petitioners should make fresh representations before the Basic Education Officer, District Hamirpur, and that any decision should be made in accordance with law. The Court, without expressing an opinion on the merits, dismissed the writ and directed the petitioners to file fresh individual applications within three weeks, after which the respondent must decide within two months. The order emphasized the need for a reasoned decision and proper hearing, effectively postponing any salary entitlement until the fresh applications are considered.
Issues considered
- Whether the petitioners are entitled to the salary and benefits of a Headmaster under the Government Order dated 16‑07‑2026.
- Whether the Court can issue a mandamus directing payment of such salary pending administrative consideration.
- Whether the petitioners must first make fresh representations before the Basic Education Officer before the Court can entertain the writ.
