Allahabad High Court

CHANDRA KISOR SINGH AND 82 OTHERSversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The Court dismissed the writ petition and directed the respondent authority to decide the pending representation/application within twelve weeks, without expressing an opinion on the merits of the increment claim.

Summary

The petitioners, a group of 83 employees, filed a writ petition seeking a mandamus directing the State of Uttar Pradesh to grant them an additional increment/selection grade after completing 19 years of service, pending a representation they had filed. The petitioners argued that the representation for the increment was still under consideration and requested the court to compel the authority to grant the increment. The State, through its standing counsel, contended that the petition was unnecessary and that the pending representation should simply be decided within a reasonable time. The Court, without expressing any view on the merits of the increment claim, disposed of the petition and ordered the respondent authority to decide the pending representation expeditiously, preferably within twelve weeks of the certified copy of the order, after giving a hearing. The order thus dismissed the writ petition while directing administrative action on the pending application.

Issues considered

  • What relief, if any, should be granted by the Court in a writ petition seeking mandamus for an additional increment after 19 years of service?
