Allahabad High Court

DR. VIMAL SINGHversusSTATE OF UP AND 2 OTHERS

Decided

Holding

The petition is disposed of with a direction to the respondent to decide the pending representation within twelve weeks, without expressing any opinion on the merits.

Summary

The petitioner, Dr. Vimal Singh, filed a writ petition seeking an interim mandamus directing the State to release his salary and Special ACP benefits payable after 17 and 24 years of service, along with interest. He had also submitted a representation/application for the same relief, which was pending before the respondent authority. The State argued that the petition served no useful purpose and that the respondent should simply decide the pending representation within a reasonable time. The Court, without expressing any view on the merits, ordered the respondent to decide the representation expeditiously, preferably within twelve weeks of the certified copy of the order, after giving a hearing. Consequently, the petition was disposed of with the said direction.

Issues considered

  • What is the appropriate relief, if any, that a High Court can grant in a writ petition seeking interim mandamus for release of salary and benefits?
