Allahabad High Court

SUSHILA MAURYAversusSTATE OF UP AND 4 OTHERS

Decided

Holding

The Court held that the petitioner must first obtain correction of the erroneous experience certificate from the issuing authorities before the Commission can verify and consider her eligibility.

Summary

The petitioner, Sushila Maurya, filed a writ petition seeking that the Uttar Pradesh Subordinate Service Selection Commission treat her as a qualified candidate for the post of Health Worker (Mahila) by awarding 15 marks for her contractual service, despite a wrong roll number on her experience certificate. The petitioner argued that the incorrect roll number led the Commission to disregard her experience, and she had filed a representation for correction. The respondent Commission contended that it has no role in correcting the certificate, which must be done by the issuing authorities (respondents No.3 and 4) before the Commission can verify and forward the matter. The Court directed the petitioner to approach the issuing authorities within three days for correction, after which the corrected certificate should be verified and forwarded to the Commission within a week. The petition was disposed of, granting the petitioner liberty to seek redress from the appropriate authorities.

Issues considered
