Holding
The writ petition is disposed of, and the respondent is directed to decide the pending representation within twelve weeks.
Summary
Udham Singh, a Gram Vikas Adhikari, filed a writ petition seeking protection and fixation of his pay. He had already submitted a representation to the second respondent on 11 September 2026 regarding the same matter. The standing counsel argued that the petition was redundant since the representation was pending. The Court agreed that maintaining the writ would serve no useful purpose. Consequently, the petition was disposed of, with an order directing the second respondent to consider and decide the representation within twelve weeks, after serving notice and providing a hearing, unless any other legal impediment exists.
Issues considered
- Whether a writ petition seeking pay fixation is maintainable when the petitioner has already filed a representation on the same issue before the concerned authority.

Court No. - 33
HON'BLE MANISH KUMAR NIGAM, J.
1. By means of present writ petition, petitioner is claiming benefit of
protection/fixation of pay in respect of his post of Gram Vikas Adhikari. In this
regard, petitioner has already moved a representation before respondent no.2
on 11.9.2026.
2. Learned Standing Counsel has submitted that since the petitioner has
already approached respondent no.2, no useful purpose would be served in
keeping this writ petition pending.
3. In view of the above, this writ petition stands disposed of with a direction to
respondent no.2 to consider and decide the above-mentioned representation
filed by the petitioner, in accordance with law, expeditiously, preferably within
twelve weeks from the date of production of a certified copy of this order,
after ensuring service of notice upon all the respondents and providing
opportunity of hearing to all the concerned parties provided there is no other
legal impediment.
