Allahabad High Court

FARZANA BEGUMversusSTATE OF UTTAR PRADESH AND 2 OTHERS

Decided

Holding

The writ petition is disposed of, with a direction to the respondent authority to decide the pending representation within twelve weeks.

Summary

Petitioner Farzana Begum filed a writ petition seeking extraordinary pension, retiral dues and terminal benefits of her husband who died on 17 January 2002. She had already submitted a representation to the respondent authority, the State of Uttar Pradesh, for the same relief. The learned Standing Counsel argued that the petition was redundant since the representation was pending before the authority. The High Court observed that keeping the writ petition pending would serve no useful purpose. Consequently, the Court disposed of the petition and directed the respondent authority to consider and decide the representation expeditiously, preferably within twelve weeks, after serving notice and providing a hearing to all parties.
