Allahabad High Court

SANJAY KUMAR PANDEYversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The petition is not maintainable because the petitioner failed to approach the relevant authority, and therefore the writ petition is dismissed.

Summary

The petitioner, Sanjay Kumar Pandey, filed a writ petition seeking a mandamus directing the respondents, the State of U.P. and others, to consider his case without first approaching the appropriate authority for grievance redressal. The Court examined whether the petition was maintainable given the procedural requirement of exhausting alternative remedies. It held that the petition was not maintainable because the petitioner had not approached the relevant authority. Consequently, the Court declined to interfere in the matter. The petition was dismissed at this stage.

                                    1. This petition has been filed for a mandamus directing the respondents
to consider the case of the petitioner without even approaching the
relevant authority for redressal of the grievances. As such the writ petition
                                    is not maintainable.
