Holding
The petitioner is entitled to pensionary benefits fixed on the basis of his last drawn pay as officiating principal.
Summary
Anup Kumar Dwivedi, who served as an officiating principal of an intermediate college from 31 July 2018 until his retirement on 31 March 2025, filed a writ petition seeking pensionary benefits on the basis of his last drawn pay as officiating principal. The petitioner relied on earlier judgments of this Court, notably the Full Bench decision in Surendra Prasad Agnihotri v. State of U.P., which held that an officiating principal cannot be denied service benefits, including pension, based on seniority and qualifications. The respondents did not dispute this proposition. The Court, finding the legal question already settled, disposed of the petition at the admission stage and directed the authorities to fix the petitioner’s pension on the basis of his last drawn pay as officiating principal within 30 days of the order. The petition was thus disposed with directions for expeditious implementation of the pension benefit.
Issues considered
- Whether an officiating principal who retires is entitled to pensionary benefits calculated on the basis of his last drawn pay as officiating principal rather than as a teacher.
