Allahabad High Court
RUPALI TRIPATHI AND ANOTHERversusSTATE OF U.P. AND 2 OTHERS
- Decided

Holding
The Court disposed of the writ petition, directing the petitioners to make fresh individual applications which the respondent shall consider in accordance with law.
Summary
The petitioners filed a writ petition seeking a direction for the respondents to pay House Rent Allowance (HRA) in accordance with a prior Full Bench judgment (Uma Shankar Singh v. State of U.P.) and to decide a representation dated 11‑12‑2025. The petitioners claimed they had approached the concerned authority but received no response. The respondents argued that the earlier judgment was not applicable but offered to consider any fresh individual representations. The Court, without expressing an opinion on the merits, ordered the petitioners to file fresh individual applications with the Basic Shiksha Adhikari (respondent No.3) within three weeks, attaching a certified copy of the order. The respondent was directed to decide the applications expeditiously, within six weeks, after giving a hearing and issuing a reasoned order. Consequently, the writ petition was disposed of, directing fresh representations rather than granting the immediate relief sought.
Issues considered
- Whether the respondents are bound to pay House Rent Allowance to the petitioners as per the judgment in Uma Shankar Singh v. State of U.P.
