Allahabad High Court

JAI PRAKASH YADAVversusSTATE OF U.P. AND 4 OTHERS

Decided

Holding

The petition is wholly misconceived and is dismissed.

Summary

The petitioner, Jai Prakash Yadav, filed a writ petition seeking a mandamus directing the respondents to consider his claim that a forged high school marks sheet was used to obtain service in the Assam Rifles, and also to compel certain respondents to decide his representations dated 27 June 2025 and 17 October 2025. The petition alleged that the respondents had failed to act on his claim and representation, thereby causing injustice. The High Court examined the petition and found it to be wholly misconceived, indicating that the reliefs sought were either legally untenable or procedurally defective. No substantive discussion on the merits of the forged document claim or the pending representations was undertaken. Consequently, the Court dismissed the petition in its entirety. The order was pronounced by Justice Manish Kumar Nigam in the presence of counsel for respondent No. 4.

Issues considered

  • What is the appropriate judicial remedy, if any, for a petitioner alleging that a forged high school marks sheet was used to obtain service in the Assam Rifles?
  • Whether the respondents are obligated to decide the petitioner’s representations dated 27 June 2025 and 17 October 2025 within a time‑frame fixed by the Court.
