Allahabad High Court
SURENDRA PRATAP SINGHversusSTATE OF UTTAR PRADESH AND 4 OTHERS
- Decided
- Bench
- MANJU RANI CHAUHAN
Holding
The court held that the petitioner must first make a fresh representation before the District Basic Education Officer, and therefore did not grant the writ of mandamus.
Summary
The petitioner, a government assistant teacher, was suspended and jailed on 3 September 2019 after an FIR was lodged under Sections 498‑A, 304‑B, 323 IPC and the Dowry Prohibition Act following his wife's suicide. He was reinstated on 24 November 2022 on the condition that salary for the suspension period would be paid only after the criminal case concluded. The petitioner was acquitted on 6 April 2024 and the State’s appeal was dismissed on 16 January 2025, but he had not received any back salary or benefits. He filed a writ petition seeking mandamus directing the respondents to pay full salary, regularise his service and award interest. The respondents argued that he performed no work while in jail and therefore was not entitled to salary, but offered to consider a fresh representation. The High Court, without expressing an opinion on the merits, dismissed the writ and directed the petitioner to make a fresh representation before the District Basic Education Officer within three weeks, after which the authority must decide the claim in accordance with law.
Issues considered
- Whether a government employee who was suspended and incarcerated, but later acquitted, is entitled to back salary and benefits for the suspension period.
- Whether the court can issue a mandamus directing payment of salary absent a fresh representation before the competent authority.
- Whether the suspension period can be treated as continuous service for purposes of service benefits.
