Allahabad High Court

MOHD. SALMAN ANSARIversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The Court disposed of the writ petition at the admission stage, directing the respondent to consider the representation dated 25‑05‑2026 and decide within two months.

Summary

The petitioner, Mohd. Salman Ansari, filed a writ petition seeking a mandamus directing the State of U.P. and other respondents to release his pending June 2023 salary of approximately Rs. 90,000‑100,000, along with interest at 18% on the General Provident Fund and gratuity amounts that had been withheld for about one and a half years. He also urged the court to order a final decision on his representation dated 25‑05‑2026. The respondents, represented by the Standing Counsel, contended that the representation should be considered in accordance with law. The Court, after hearing counsel, found that the petition could be disposed of at the admission stage and, by consent of the parties, directed the respondent authority to consider the representation and decide within two months of receiving a certified copy of the order. Consequently, the writ petition was dismissed without further adjudication on the merits.
