Allahabad High Court

MEERA CHAUHAN AND ANOTHERversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The court ordered the respondent to consider and decide the petitioners' representations on service regularisation within twelve weeks, without examining the merits.

Summary

Petitioners Meera Chauhan and another filed a writ petition seeking a decision on their representations dated 23-07-2026 and 24-07-2026 for regularisation of their service. The standing counsel argued that the petition was redundant since the representations had already been made and that the court should direct the respondent to consider them. The court ordered the State of U.P. (respondent No.1) to consider and decide the representations in accordance with law, after giving a hearing to all concerned parties, within twelve weeks of the certified copy of the order. The court expressly stated that it had not examined the merits of the service regularisation claim and was issuing the order strictly on procedural grounds. Consequently, the petition was disposed of.

                                    Counsel for Respondent(s) : C.S.C.

                                    Court No. - 33
                                                      HON'BLE MANISH KUMAR NIGAM, J.

                                    1. By means of present writ petition, petitioners have prayed for decision
on their representations dated 23.07.2026 and 24.07.2026 seeking for
                                    regularization of their service.

                                    2. Learned Standing Counsel has submitted that as petitioners have
already represented, no useful purpose would be served in keeping this
petition pending and it would be appropriate that respondent be directed
to consider the grievance of the petitioners in accordance with law.

                                    3. In view of these facts, respondent No. 1 is directed to consider and
decide the representations dated 23.07.2026 and 24.07.2026 of the
petitioners in accordance with law, after providing opportunity of hearing
to all the concerned parties, expeditiously, preferably within a period of
twelve weeks from the date of production of certified copy of this order.

                                    4. It is made clear that this court has not examined the matter on merits
and the order shall be passed strictly in accordance with law.

                                    5. Accordingly, the petition stands disposed of.

                                                                                     (Manish Kumar Nigam,J.)
                                    October 1, 2026
