Allahabad High Court

ANEES AHMADversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The court disposed of both writ petitions, directing the respondents to re‑examine the penal rent calculation and to decide within three weeks of the petitioner's representation.

Summary

The petitioner, Anees Ahmad, vacated government premises and challenged the respondents' calculation of a penal rent amounting to approximately Rs. 11 lakh. The petitioner objected to the calculation but did not provide detailed particulars. The High Court observed that the two writ petitions filed could be consolidated and directed the respondents to examine the penal rent computation. The court granted the petitioner a 48‑hour window to submit a detailed representation by Dasti Service. Upon receipt, the respondents were instructed to decide on the matter within three weeks, failing which the timeline would not be binding. The court disposed of both writ petitions, leaving the matter to be resolved on the basis of the forthcoming representation and the respondents' subsequent order.

Issues considered

  • Whether the respondents' calculation of penal rent of Rs. 11 lakh is correct.

                                    With Writ-A No.2462 of 2026.

                                    Court No. - 32

                                               HON'BLE SAURABH SHYAM SHAMSHERY, J.

                                    1. Heard Sri Nawal Kishor Mishra, learned counsel for the petitioner and
Sri Sumit Suri, learned counsel for the respondents.

                                    2. This Court is being unnecessary burdened with two writ petitions when
all the grounds can be taken in one writ petition.

                                    3. The petitioner has already vacated Government premises and now only
issue is whether calculation made by respondents for penal rent which is
about Rs.11 lakh is correct or not since petitioner has objected it, though
details of it are not specifically mentioned, still in the interest of justice
both the writ petitions are disposed of with an observation that
respondents will look into the calculation of the petitioner and for that
liberty is granted to the respondent so that concerned authority may pass a
specific order whether to accept it or not within a short period..

                                    4. In case, petitioner provides all details by way of a representation within
48 hours, by way of a Dasti Service, concern respondent will take a
decision within a period of 3 weeks thereafter. In case of default,
responders are not required to follow direction of time line.

                                                                                (Saurabh Shyam Shamshery,J.)
