Allahabad High Court

SMT.MANJU SINGHversusSTATE OF U.P. AND 4 OTHERS

Decided

Holding

The impugned order is set aside and the respondents are directed to take a fresh decision within six months.

Summary

Manju Singh filed a writ petition challenging an order passed by the State of Uttar Pradesh and other respondents. The petitioners, represented by Senior Advocate Shantanu Khare and counsel Ashok Khare with Mohd. Yaseen, argued that the impugned order was contrary to a precedent set by a coordinate bench of the same High Court in Ram Naresh Singh v. State of U.P. (Writ A No. 28607/2014). The Court examined the earlier judgment and found that the respondents were required to reconsider the matter in light of that decision. Consequently, the Court set aside the impugned order and directed the concerned respondent to take a fresh decision within six months. The direction was issued to ensure compliance with the legal principles established in the cited precedent. The writ petition was thereafter disposed of with the observations recorded.

Issues considered

  • Whether the impugned order passed by the State of U.P. should be set aside in view of the coordinate bench judgment in Ram Naresh Singh v. State of U.P.
  • Whether the respondents are required to take a fresh decision within a specified time frame.
