Allahabad High Court
C/M, CHRISTIAN INTER COLLEGE, FARRUKHABAD, AND ANOTHERversusSTATE OF U.P. AND 3 OTHERS
- Decided
Holding
The petition is dismissed as infructuous because the order challenged has likely been executed and no interim relief is sought.
Summary
The Committee of Management of Christian Inter College, Farrukhabad filed a writ petition in 2018 challenging an order dated 31 May 2018 that directed the State of Uttar Pradesh and others to initiate proceedings to fill the post of Manager. No party appeared before the court on the scheduled date, and the standing counsel informed the bench that the petition had become infructuous because the impugned order had likely been executed. The court noted that there was no interim relief sought and, given the lapse of time, there was no justification to keep the petition pending. Consequently, the court held that the petition could not be entertained further. The writ petition was therefore dismissed.
