Allahabad High Court

RAM NARESH SINGHversusMANAGING DIRECTOR, U.P. JAL NIGAM AND 2 OTHERS

Decided

Holding

The court directed the respondents to pay all admissible retirement dues within three months, with interest at 6% per annum thereafter if payment is delayed.

Summary

Ram Naresh Singh, a former employee of U.P. Jal Nigam, filed a writ petition seeking a mandamus directing the employer to pay his retirement dues, including gratuity, leave encashment, arrears of dearness relief at rates ranging from 164% to 212%, and interest of 9% from 29 February 2024. The respondents contended that the admissible dues would be paid in a time‑bound manner. The High Court examined the claim and directed the respondents to clear all admissible dues within three months of the certified copy of the order, failing which the petitioner would be entitled to interest at 6% per annum from the expiry of the three‑month period until actual payment. The Court noted that the direction was in the nature of a mandamus. With these observations, the writ petition was disposed.

Issues considered
