Holding
The petition was dismissed because the NCTE notification mandates TET as the qualifying requirement, rendering the BTC certificate insufficient.
Summary
Jayjeet Maurya filed a writ petition seeking to quash the orders of the District Basic Education Officer, Shahjahanpur, which denied his appointment as an Assistant Teacher on the ground that his BTC training certificate was not a valid qualification. He requested that the respondents consider him for appointment, treating the BTC certificate as sufficient. The State of U.P. and other respondents contended that, following the notification dated 23‑08‑2010, the National Council for Teacher Education (NCTE) had made the Teacher Eligibility Test (TET) a mandatory qualification for such appointments. The court examined the effect of the notification and held that the statutory requirement of a TET qualification superseded the petitioner’s BTC certificate. Consequently, the court dismissed the writ petition, refusing to grant the relief sought.

Court No. - 52
HON'BLE MRS. MANJU RANI CHAUHAN, J.
Heard Mr. Sanjeev Kumar Khare, learned counsel for the petitioner,
and Ms. Anuradha Sundaram, learned Additional Chief Standing
Counsel, and learned counsel for the respondent-BSA.
The writ petition has been filed with a prayer to quash the orders
dated 27.02.2016/01.03.2016 passed by the District Basic Education
Officer, Shahjahanpur, and with a further prayer to direct the
respondents to forthwith accord consideration to the petitioner for
appointment as an Assistant Teacher in a Junior Basic School of
District Shahjahanpur, treating the BTC training certificate possessed
by the petitioner to be a valid qualification.
Learned Additional Chief Standing Counsel submits that, after the
coming into force of the notification dated 23.08.2010, the NCTE
has made TET to be mandatory qualification for appointment to the
post of Assistant Teacher. Accordingly, the relief as prayed for
cannot be granted.
In view of the aforesaid, the writ petition is dismissed.
