Allahabad High Court

ASHISH KUMAR YADAVversusSTATE OF UP AND 2 OTHERS

Decided

Holding

The High Court held that it could not direct the State Public Service Tribunal to decide the pending claim petition within a stipulated period and dismissed the writ petition.

Summary

The petitioner, Ashish Kumar Yadav, filed a writ petition seeking a mandamus directing the State Public Service Tribunal, Uttar Pradesh, to decide his pending claim petition (No. 2179 of 2024) within a time frame set by the court. The petition argued that the Tribunal had unduly delayed the disposal of his case. The court examined whether it had the jurisdiction to issue such a direction to a quasi‑judicial tribunal. Noting the lack of information about the Tribunal's case load and its own limited authority to dictate procedural timelines of tribunals, the court declined to intervene. Instead, it advised the petitioner to approach the Tribunal directly for early disposal. Consequently, the writ petition was dismissed without any order as to costs.
