Allahabad High Court

BALDUversusU.P. STATE BRIDGE CORPORATION LTD., THROUGH ITS MANAGING DIRECTOR AND 4 OTHERS

Decided

Holding

The petition is dismissed pending the petitioner’s fresh representation and a subsequent hearing, after which the respondent must decide the matter within the stipulated period.

Summary

The petitioner, a former Class IV employee of U.P. State Bridge Corporation Ltd., retired on 31 May 2015 and challenged a letter dated 09‑Nov‑2024 that purportedly reduced his post‑retirement payments. He alleged that the corporation calculated his retiral dues without considering his objection and without affording a hearing, thereby violating statutory provisions. The petitioner sought certiorari to quash the letter and mandamus directing payment of gratuity, EPF, salary arrears, leave encashment, pension, group insurance and allowances on the basis of his revised last drawn salary, with interest and penal interest. The respondents submitted that the objection would be considered in accordance with law within a reasonable time. The Court directed the petitioner to file a fresh representation detailing reasons for the reduced dues within one month and ordered the corporation to decide the representation within two months after giving the petitioner a hearing. Consequently, the writ petition was disposed.

Issues considered

  • Whether the respondent’s calculation of retiral dues without hearing the petitioner’s objection violates principles of natural justice and statutory requirements.
  • Whether the petitioner is entitled to a writ of certiorari to quash the respondent’s letter and a writ of mandamus directing payment of the full retiral benefits.
  • Whether the court can conditionally dispose the petition pending a fresh representation and hearing.

                                                                    2

has retired on 31.05.2015 and some of the retiral dues have been released,
however, quantum of the release of retiral dues is not in accordance law.

objections raised by the petitioner are required to be considered in
                                    accordance with law.

                                    5. Considering the facts and circumstances of the case, it is hereby provided
that petitioner shall file fresh representation giving detail reasons to the

along with a certified copy of this order. In the event any such representation
is filed, respondent no.1 shall decide the same within a period of two months
thereafter after giving opportunity of hearing to the petitioner.

                                    6. With the aforesaid observation/direction, the writ petition stands disposed
