The termination order dated 26‑03‑1998 is set aside and the petitioner is entitled to reinstatement with back wages and full service benefits.
Summary
The petitioner, a Lekhpal appointed in 1985, was transferred to a new posting on 30‑09‑1997. Shortly thereafter, a preliminary inquiry alleged that forged entries had been made in revenue records prior to his joining, and he was suspended and later terminated on 26‑03‑1998. The petitioner contended that the alleged offences occurred before his posting and that he was denied a fair hearing; he was subsequently acquitted of the same charges in a criminal trial (Criminal Case No. 7713 of 2020). The High Court examined whether the disciplinary proceedings were valid despite the timing of the alleged acts, the denial of natural justice, and the effect of the criminal acquittal. Finding that the charges related to a period before the petitioner’s posting and that he was not given an opportunity to defend himself, the Court held the termination order unlawful. Consequently, the Court set aside the termination, ordered reinstatement with 50% back wages up to superannuation, and directed payment of all consequential benefits.
Issues considered
- Whether the termination of the petitioner’s service was valid when the alleged forged entries were made before his posting.
- Whether the disciplinary proceedings complied with the principles of natural justice, particularly the right to a fair hearing.
- Whether an acquittal in the criminal case bars the disciplinary authority from imposing termination.
- Whether the petitioner is entitled to reinstatement, back wages, and other service benefits.

4. After service of the aforesaid charge sheet, the petitioner submitted his
explanation categorically explaining each and every charge and
specifically making the averments that he has been transferred on
30.09.1997 at Halka Akbarpur Garhi, Tehsil Mawana, District Meerut on
30.09.1997 and the entries in question are made prior to joining of the
petitioner at Halka Akbarpur Garhi. Therefore, the same cannot be
attributed to the petitioner herein and the same might have been done by
the previous Lekhpal. After the submission of the aforesaid reply on
10.03.1998, the Inquiry Officer has submitted its inquiry report
concluding all the charges leveled against the petitioner are proved vide

its inquiry report dated 21.03.1998. Thereupon, the respondent no.1, the
disciplinary authority, has passed the impugned order terminating the
services of the petitioner and has also directed for registration of a
criminal case against the petitioner.
5. Pursuant to the aforesaid direction issued by the respondent no.1, the
Criminal Case No. 7713 of 2020 (State vs. Ravindra Pal Singh) arising
out of Case Crime No. 54 of 1998, under section 420, 467, 468, 471 IPC
at P.S. Hastinapur, District Meerut was also registered against the
petitioner, which was tried by the Judicial Magistrate, Meerut and after
due trial, the petitioner has been acquitted from all the charges leveled
against the him vide judgment and order dated 25.10.2021 passed by the
Judicial Magistrate, Room No.3, Meerut. The copy of the aforesaid
judgment passed by the trial court has been annexed in the supplementary
affidavit as Annexure SA-1 filed on behalf of the petitioner on
25.01.2024.
6. Learned Additional Chief Standing Counsel for the State is not in a
position to state whether any appeal against the said acquittal order has
ever been filed on behalf of the State.
7. Being aggrieved by his termination order dated 26.03.1998, the instant
writ petition was filed on behalf of the petitioner. Learned counsel for the
petitioner submits that a perusal of the charge sheet makes it apparent that
the incidents narrated therein relate to a period prior to the date of the
petitioner's joining at the relevant place, namely Halka Akbarpur Garhi
and the documents which were uh Akbarpur Garhi on 30.09.1997 and the
documents relied upon in support of the charge sheet are the report of the
Revenue Inspector dated 24.09.1997, report of the Lekhpal Sri Surendra
Pal dated 25.06.1997, the statement of Sri Charan Singh dated 23.09.1997
and the Khatauni in question where such entries were made. In the entire
charge sheet, none of the documents after the joining of the petitioner at
Village Akbarpur Garhi has been relied upon in the charge sheet itself,
which categorically establishes that the incident of interpolation or
making the forged entries in the Khatauni were prior to the date of joining
of the petitioner at Village Akbarpur Garhi as Lekhpal. Therefore, for the
WRIA No. 37961 of 1998
5
aforesaid interpolation or making the forged entry, the petitioner cannot
be held responsible by any stretch of imagination.
8. It is further submitted by the learned counsel for the petitioner that after
the submission of the inquiry report, no opportunity whatsoever was
given to the petitioner. Specifically, neither a copy of the report was
supplied nor was any chance provided to show cause against it. After
submission of the inquiry report on 21.03.1998, the disciplinary authority
passed the impugned termination order on 26.03.1998 in undue haste
against the petitioner and the direction for registration of the criminal case
was also issued by the disciplinary authority, pursuant thereto the criminal
case was registered against him, in which the petitioner after due trial, has
been honorably acquitted by the trial court concerned. In such view of the
matter, learned counsel for the petitioner submits that the impugned order
is not sustainable in law and is liable to be quashed. Further, in view of
the honorable acquittal of the petitioner in the criminal trial of the same
charges, the impugned termination order is liable to be quashed.
9. Learned Additional Chief Standing Counsel for the State submitted that
disciplinary proceedings were duly conducted against the petitioner. An
explanation was sought from the petitioner, who chose not to cross-
examine any witnesses during the inquiry. Based on the material
available, the Inquiry Officer concluded that the charges against the
petitioner were proven. Furthermore, the petitioner did not request an
opportunity for a personal hearing. Therefore, there was no illegality
while conducting the disciplinary proceeding against the petitioner herein.
However, learned Additional Chief Standing Counsel for the State on the
basis of the record available in the instant case is not in a position to
dispute the date of joining of the petitioner as 30.09.1997 at village
Akbarpur Garhi and all the documents relied upon in the charge-sheet are
prior to 30.09.1997.
10. Having heard the rival submissions so made by learned counsel for
the parties, this Court has carefully gone through the record of the case.
The facts of the case have already been noted in great detail. In the instant
case, it is undisputed that the petitioner has joined at the relevant place i.e.
village Akbarpur Garhi, Tehsil Mawana, District Meerut on 30.09.1997 as
WRIA No. 37961 of 1998
6
Lekhpal. From the perusal of the charge-sheet, which has already been
quoted herein above, it is apparent that all the allegations of interpolation
or forgery in the revenue record or making the forged entries in the
revenue record relates to the period prior to joining of the petitioner at
village Akbarpur Garhi and the clear stand has been taken by the
petitioner in his reply to the charge-sheet in this regard. Despite that, the
Inquiry Officer on the basis of the fact that after joining, the petitioner did
not intimate or inform the higher officer with regard to such interpolations
or the forged entries made in the revenue record, therefore, he has been
held guilty of the charges leveled against him with regard to making of
the aforesaid forged entries, which relate to the period prior to joining of
the petitioner herein.
11. In such circumstances, this Court has no manner of doubt that the
disciplinary authority as well as the Inquiry Officer has proceeded against
the petitioner without any foundational basis and without any material
against the petitioner. It is unreasonable to expect a person, immediately
after joining a new place following a transfer, to examine every single
document handed over to them within the span of a month. Barely a
month later, on the basis of a preliminary inquiry report dated 04.11.1997,
disciplinary proceedings were initiated and the petitioner was placed
under suspension. The non-involvement of the petitioner with regard to
the allegations, it is apparent from the charge-sheet itself and further the
same is fortified by the judgment of acquittal recorded by the Judicial
Magistrate, Court No. 3, Meerut on 25.10.2021.
12. After perusal of the entire judgment as well as the operative portion,
this Court is of the considered opinion that the acquittal of the petitioner
in the criminal case is an honorable acquittal. Relevant part of the
judgment and findings recorded by the trial court are as under :
WRIA No. 37961 of 1998

13. Otherwise also, from the plain reading of the charge-sheet itself, it is
apparent in the instant case that the charges leveled against the petitioner
were related to the period prior to the joining of the petitioner. Therefore,
the petitioner cannot be attributed any guilt with regard to the aforesaid
forged entries made in the khatauni in question.
12. In such view of the matter, the impugned order dated 26.03.1998 is
not sustainable in law. Accordingly, the same is hereby set aside.
13. It is submitted by learned counsel for the petitioner that the petitioner
has already attained the age of superannuation in the year 2021, in such
view of the matter, the petitioner is directed to be paid the 50% back
wages from the date of termination till he attained the age of
superannuation and the petitioner shall be granted continuity in service till
the age of his superannuation. Thereafter from the date of superannuation,
he shall be paid all consequential benefits including gratuity, pension,
leave encashment, etc. All the aforesaid dues shall be paid to the
petitioner within a period of three months from the date of production of
certified copy of this order. If not paid within three months, the amount
payable to the petitioner, will carry interest at the rate of 8% per annum.
14. The writ petition is allowed accordingly.
