Allahabad High Court

PREM RAJ AND 26 OTHERSversusSTATE OF U.P. AND 5 OTHERS

Decided

Holding

Mandamus cannot be granted as the petition does not disclose any legal provision entitling the petitioners to regularisation.

Summary

The petitioners, a group of contract workers, filed a writ petition seeking a mandamus directing the State of Uttar Pradesh to regularise their employment. The Court observed that the petition did not cite any legal provision that would entitle the petitioners to regularisation. Consequently, the Court held that a mandamus could not be issued. However, the Court noted that if the respondents later formulate a policy for regularisation, the petitioners' claims could be considered, and they may approach the respondents with factual and legal averments. The petition was therefore disposed of.

Issues considered

  • Whether contract workers are entitled to regularisation under any legal provision.
  • Whether a writ of mandamus can be issued to compel the State to regularise the petitioners.

Subjects

  • regularisation
  • contract employees
  • mandamus
