Allahabad High Court

NEERAJ KUMAR SINGHAIversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The Court did not decide the substantive right to renewal but directed the petitioner to make a fresh representation within three weeks before the District Basic Education Officer.

Summary

The petitioner, Neeraj Kumar Singhai, who was engaged as a Part‑Time Instructor, filed a writ petition seeking renewal of his engagement. He alleged that the authorities had not acted on his request for renewal. The Court observed that the prayers in the petition were not properly framed. However, in the interest of justice, the Court directed the petitioner to file a fresh representation within three weeks before the District Basic Education Officer, Lalitpur, to have his claim considered. The Court expressly stated that it was not expressing any opinion on whether the petitioner has a legal right to renewal. Consequently, the writ petition was disposed of.
