Allahabad High Court
BARUN KISHOR SHUKLAversusSTATE OF U.P. AND 3 OTHERS
- Decided
Holding
The petition is disposed, granting the petitioner liberty to file an appeal under the 2020 Discipline and Appeal Rules.
Summary
Barun Kishor Shukla filed a writ petition challenging a minor disciplinary punishment imposed by the State of Uttar Pradesh and three other respondents. The petitioner argued that a statutory remedy exists under the Uttar Pradesh Power Transmission Corporation Limited Establishment (Discipline and Appeal) Rules, 2020, which allows an appeal against such punishment. The learned counsel for the petitioner sought a direction that the writ petition be disposed of, granting the liberty to file the appeal. The High Court, after hearing counsel for both sides, disposed of the petition and expressly permitted the petitioner to pursue the appeal under the 2020 Rules. No substantive discussion on the merits of the punishment was made, as the court focused solely on the procedural right to appeal.
