Allahabad High Court
DR. FARHAT BANOversusSTATE OF U.P. AND 4 OTHERS
- Decided
Holding
The court held that the petition for consideration of the pension representation (prayer‑2) is maintainable and disposed of the writ petition, directing a fresh representation to be filed.
Summary
The petitioner, Dr. Farhat Bano, filed a writ petition seeking two reliefs, but later instructed counsel to pursue only the second prayer, which sought consideration of a representation for fixation of pension in accordance with law. The High Court examined the petition and determined that the second prayer was maintainable. Consequently, the court disposed of the writ petition, directing the petitioner to file a fresh representation containing all relevant facts and documents before the concerned respondent. The court ordered that the respondent consider the fresh representation expeditiously, within eight weeks. No substantive merits of the pension claim were adjudicated, as the petition was dismissed pending a fresh application.
