Allahabad High Court
NIRANJAN LALversusSTATE OF U.P. AND 5 OTHERS
- Decided
Holding
The writ petition was disposed of, with the court relying on the respondents' assurances to provide dues details and settle any outstanding amounts within a stipulated period.
Summary
The petitioner, a former employee of U.P. Jal Nigam (Rural), retired on 31 July 2021 and filed a writ petition alleging that he had not been informed of the total dues payable to him, nor the manner of their payment. He also raised concerns about a pending group insurance claim. The respondents, including U.P. Jal Nigam (Rural) and the Department, assured that detailed information on his dues would be provided within three weeks and that any remaining amounts would be cleared thereafter. The Department further promised to raise the group insurance claim within the same period. The court, noting the respondents' assurances and the absence of any specific legal violation, disposed of the writ petition without ordering any immediate relief. The petition was thus dismissed pending the respondents' compliance with their assurances.
Issues considered
- What is the petitioner entitled to receive as post-retirement dues from U.P. Jal Nigam (Rural)?
- Whether the petitioner is entitled to a group insurance claim from the Department?
- Whether the court should intervene to compel immediate payment of dues.
