Allahabad High Court
GANESHI LALversusSTATE OF U.P. AND 5 OTHERS
- Decided
Holding
The writ petition was disposed of on the basis of the department's assurances to raise the group insurance claim and clear a portion of the dues.
Summary
The petitioner, a retired employee of U.P. Jal Nigam (Urban), filed a writ petition seeking payment of pending dues to fund his daughter's marriage scheduled for 5 May 2026. The department acknowledged financial constraints but promised to clear at least one-quarter of the dues before the marriage date. The respondent LIC indicated that a claim for group insurance had not yet been raised, and the department assured that the claim would be raised within three weeks to facilitate payment. Considering these assurances, the court disposed of the writ petition without ordering any specific relief. The petition was thus closed pending the department's compliance with its promises.
Issues considered
- Whether the court should compel the department to pay the petitioner's pending dues before his daughter's marriage.
- Whether the pending group insurance claim affects the petitioner's entitlement to the dues.
