Allahabad High Court

RAJ NARAYAN SHUKLAversusSTATE OF UP AND 3 OTHERS

Decided

Holding

The impugned order dated 31‑12‑2025 is set aside and the matter is remanded to the respondents to pass a fresh order in terms of the directions in Vinod Kumar Srivastava v. State of U.P. and the Government Order dated 4‑Oct‑2024.

Summary

Petitioner Raj Narayan Shukla filed a writ petition challenging an order dated 31‑12‑2025. He relied on a prior decision of this Court in Tej Pal Singh v. State of U.P. (Writ‑A No.7464 of 2019) which had been set aside and directed a fresh order for regularisation. The petitioner argued that the facts of his case were analogous and that the same direction should be applied. The Additional Chief Standing Counsel could not refute these submissions. The Court, noting the precedent in Tej Pal Singh and the direction in Vinod Kumar Srivastava v. State of U.P. (Writ‑A No.21492 of 2023) as well as a Government Order dated 4‑Oct‑2024, set aside the impugned order and remanded the matter to the respondents to pass a fresh order in accordance with those directions. The writ petition was thereafter disposed.

Issues considered

  • What is the appropriate remedy when an earlier judgment directs a fresh order for regularisation in similar facts?
  • Whether the impugned order dated 31‑12‑2025 should be set aside and the matter remanded for a fresh order as per the directions in Vinod Kumar Srivastava case and the Government Order of 4‑Oct‑2024.
