Allahabad High Court

RAVINDER KUMARversusSTATE OF U.P. AND 2 OTHERS

Decided

Holding

A belated application for the examination cannot be entertained and the petition must be dismissed.

Summary

Ravinder Kumar filed a writ petition seeking permission to participate in the 2025 Assistant Teacher Trained Graduate Grade Mains Examination, alleging that his application was not considered because it was received after the deadline. The respondents, the State of U.P. and two others, argued that the examination had already been held and that the deadline was mandatory. The Court examined the Full Bench decision in Rajendra Patel v. State of U.P. (AIR 2015 Allahabad 161), which upheld strict compliance with application deadlines. Applying that precedent, the Court held that a belated application could not be entertained without violating the established rule. Consequently, the petition was dismissed.

Issues considered

  • Can a petitioner be allowed to appear for a mains examination after the examination has already been conducted?
  • Can a late submission of an application form be condoned in view of the Full Bench precedent in Rajendra Patel v. State of U.P.?
