Allahabad High Court
DEVENDRA SINGH AND 10 OTHERSversusSTATE OF U.P. AND 13 OTHERS
- Decided
Holding
The court held that each petitioner must file a separate representation and deposit Rs.100, and therefore the consolidated writ petition was disposed.
Summary
A writ petition filed by eleven petitioners sought salary entitlement as Principal while they were serving as Officiating Principals, relying on a prior judgment (Special Appeal No.209 of 2026). The High Court observed that although the cause of action was common, the orders required separate authorities, and therefore the consolidated petition could not be entertained as a single proceeding. The Court directed each petitioner to file a separate representation before the concerned respondent through the respective Committee of Management, serving it by way of Dasti. Additionally, each petitioner was ordered to deposit Rs.100 with the District Legal Services Authority, Fatehpur, as the petition was improperly consolidated. The petition was consequently disposed of with these directions.
Issues considered
- Whether the petitioners are entitled to the salary of a Principal while serving as Officiating Principals.
- Whether a consolidated writ petition can be disposed of by directing separate filings before different authorities.
- Whether each petitioner must deposit Rs.100 with the District Legal Services Authority in a consolidated petition.
Subjects
