Allahabad High Court

KRISHNA KANT YADAV AND 3 OTHERSversusTHE UNION OF INDIA, THROUGH GENERAL MANAGER, NORTH CENTRAL RAILWAY AND 5 OTHERS

Decided

Holding

The High Court held that a writ petition cannot be used to obtain an out‑of‑turn hearing from the Tribunal; the petitioners must approach the Tribunal directly.

Summary

The petitioners, Krishna Kant Yadav and three others, filed a writ petition before the Allahabad High Court seeking a direction to the Central Administrative Tribunal (CAT), Allahabad Bench, to decide O.A. No. 955 of 2018 within a stipulated time. The petition alleged that the matter was being repeatedly listed before the Tribunal but was not being heard, possibly due to the Tribunal's backlog. The Court examined whether a writ petition could be used to obtain an out‑of‑turn hearing from the Tribunal. It held that such a direction cannot be granted through a writ and that the petitioners must approach the Tribunal directly for any such relief. Consequently, the Court disposed of the petition without granting the relief sought. The decision underscores the limitation on judicial intervention in the procedural scheduling of administrative tribunals.

                                    Chief Justice's Court
                                                HON'BLE ARUN BHANSALI, CHIEF JUSTICE
                                                HON'BLE KSHITIJ SHAILENDRA, J.

                                    1. This writ petition has been filed by the petitioner seeking a direction to
the Central Administrative Tribunal, Allahabad Bench, Allahabad to
decide O.A. No. 955 of 2018 within a stipulated period.

                                    2. A perusal of the record indicates that the petition is regularly getting
listed before the Tribunal and for whatever reason, the same is not getting
heard may be because of Tribunal is overburdened with old
                                    matters/matter not getting reached.

                                    3. Filing of writ petition before this court seeking out of turn hearing
before the Tribunal, cannot be countenanced. If for any reason the
petitioner is seeking out of turn hearing, he has to approach the Tribunal
                                    for the said purpose.

                                    4. With the above observations, the petition stands disposed of.

                                                                 (Kshitij Shailendra,J.) (Arun Bhansali,CJ.)
