Allahabad High Court

DR SANDEEP KUMAR CHAUDHARY AND 38 OTHERSversusUNION OF INDIA AND 3 OTHERS

Decided

Holding

A collective writ petition filed by numerous petitioners with disparate facts is not maintainable; petitioners must file independent writ petitions.

Summary

The petitioners, a group of 39 individuals, filed a writ petition challenging the implementation of the DACP Scheme. The Court observed that the large number of petitioners made the facts jumbled and that a collective petition was not appropriate. Consequently, the Court dismissed the writ petition, granting the petitioners liberty to file separate independent writ petitions for their individual grievances. The order emphasized that filing separate petitions would not prejudice the petitioners' rights. No substantive merits of the DACP Scheme were addressed.
