Allahabad High Court
SHRI NAVIN SINGHversusREGISTRAR GENERAL OF CENTRAL ADMINISTRATIVE TRIBUNAL ALLAHABAD
- Decided
Holding
A writ petition seeking a direction to a tribunal to hear a matter out of turn is not maintainable; such urgency must be raised before the tribunal itself.
Summary
The petitioner, Shri Navin Singh, filed a writ petition before the Allahabad High Court seeking a direction to the Central Administrative Tribunal (CAT) to complete pleadings and hear the matter. The record showed that the pleadings for the 2023 matter were completed on 14 October 2024 and the case was being regularly listed before the Tribunal. The Court noted that a petition to the High Court for the Tribunal to take up a matter out of turn is not permissible, and any urgency must be raised before the Tribunal itself. No substantive grievance or urgent circumstance was demonstrated that warranted the Court's intervention. Consequently, the Court found no basis to entertain the petition and dismissed it.

HON'BLE ARUN BHANSALI, CHIEF JUSTICE

1. This petition has been filed by the petitioner seeking direction to the
Tribunal to get the pleadings completed and finally hear the matter.
2. A perusal of the record indicates that the petition pertains to the year
2023 and the pleadings apparently have been completed on 14.10.2024
and the matter is regularly getting listed before the Tribunal.
3. Filing of petitions before this Court seeking direction to the Tribunal to
take up the matter out of turn, cannot be countenanced. If the petitioner
has any issue requiring urgent attention of the Tribunal, he has to make
application before the Tribunal itself.
4. We do not find any reason to entertain the present petition. The same
is, therefore, dismissed.
