KRISHNAKANT TRIPATHIversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The petition is disposed; a fresh representation must be filed within three weeks, after which the respondents must settle the GPF amount if no legal impediment exists.

Summary

The petitioner, Krishnakant Tripathi, filed a writ petition seeking payment of his Government Provident Fund (GPF) amount and interest thereon from the State of Uttar Pradesh and other respondents. The petitioners were represented by advocates Basu Dev and Shailesh Narayan Upadhyay, while the respondents were represented by C.S.C. and the standing counsel Saurabh. The High Court examined the petition and concluded that the claim for the GPF amount could be addressed if the petitioner filed a fresh representation within three weeks. The Court directed that, subject to the absence of any legal impediment, the respondents should settle the GPF amount within three weeks of receiving the fresh representation. Regarding the claim for interest, the Court left it to the respondents to consider and decide. Consequently, the writ petition was disposed with directions for a fresh representation and subsequent payment of the GPF amount.
