Allahabad High Court
VINOD KUMAR SINGHversusState of U.P. AND 5 OTHERS
- Decided
Holding
The court set aside the impugned orders and remanded the matter to the respondent to pass a fresh order as directed in the Vinod Kumar Srivastava judgment and the Government Order dated 04‑10‑2024.
Summary
The petitioner, Vinod Kumar Singh, filed a writ petition challenging orders dated 12‑03‑2024 and 21‑03‑2024 passed by the State of U.P. and others. He relied on a prior decision of a co‑ordinate bench in Tej Pal Singh v. State of U.P. (Writ‑A No. 7464 of 2019) which had been set aside and remanded for a fresh order in accordance with the judgment in Vinod Kumar Srivastava v. State of U.P. (Writ‑A No. 21492 of 2023). The petitioner argued that the facts were analogous and the same direction should apply. The respondent could not refute these submissions. The court, noting the earlier precedents, set aside the impugned orders and directed the respondent to issue a fresh order as per the Srivastava judgment and the Government Order dated 04‑10‑2024. The writ petition was thereafter disposed.
Issues considered
- Whether the impugned orders dated 12‑03‑2024 and 21‑03‑2024 should be set aside and a fresh order issued in line with the precedent set in Tej Pal Singh v. State of U.P. and Vinod Kumar Srivastava v. State of U.P.
