Allahabad High Court
BRIJ PAL SINGHversusSTATE OF U.P. AND 3 OTHERS
- Decided
Holding
A complainant lacks locus standi to compel the court to expedite an inquiry; therefore, mandamus cannot be granted.
Summary
The petitioner, Brij Pal Singh, filed a writ petition seeking a mandamus directing the State of Uttar Pradesh and others to expedite an inquiry against a private respondent. The Court examined whether a complainant has locus standi to compel the court to accelerate such an inquiry. It held that the petitioner, being merely a complainant, does not have the requisite standing to approach the Court for expediting the investigation. Consequently, the prayer for mandamus was denied. The writ petition was therefore disposed of.
