Since the criminal case has been closed, there is no legal impediment to releasing the petitioner’s pensionary benefits, and the respondents must do so.
Summary
The petitioner, a retired Sub Inspector of the Uttar Pradesh Police, filed a writ petition seeking a mandamus directing the State to pay his gratuity, post‑retirement benefits, full pension and arrears that had been withheld due to the pendency of a criminal case (Crime No. 431 of 1996). The criminal case was later closed by a Lok Adalat order dated 14 May 2022, and no adverse order against the petitioner existed. The petitioner argued that the closure removed any legal bar to releasing his pensionary benefits. The Court examined the fact that the benefits were withheld solely because of the pending case, which is now terminated. Finding no legal impediment, the Court directed the respondents to release all pensionary benefits within three months and disposed of the petition.
Issues considered
- Whether the pendency of a criminal case (Crime No. 431 of 1996) bars the release of pension, gratuity and post‑retirement benefits to a retired police officer.
- Whether the closure of the criminal case by Lok Adalat removes the obstacle to payment of the petitioner’s pensionary benefits.
- Whether the petitioner is entitled to arrears of pension from 1 July 2013 along with interest.
