Allahabad High Court

LIYAKAT ALIversusSTATE OF U.P. AND 2 OTHERS

Decided

Holding

The petition is disposed of without deciding the merits, and the petitioner is at liberty to ventilate his salary grievance before the respondents.

Summary

Petitioner Liyakat Ali filed a writ petition seeking a mandamus directing the State of U.P. and others to address his grievance regarding salary. The petitioner’s counsel argued that the petition should not be decided on its merits and requested that the mandamus prayer be considered. The Court held that the petitioner's submission was not appropriate but, in the interest of justice, disposed of the petition without deciding the merits, granting the petitioner liberty to raise his salary grievance before the concerned respondents. No substantive order on mandamus was issued. The petition was therefore dismissed, with the petitioner allowed to approach the respondents separately.
