Allahabad High Court

SUPRIT JOHN JOSHIversusSTATE OF U.P. AND 4 OTHERS

Decided

Holding

The writ petition is dismissed; the petitioner must file a fresh representation for salary arrears.

Summary

The petitioner, Suprit John Joshi, a government employee, filed a writ petition before the Allahabad High Court seeking direction for the payment of arrears of salary. The respondents, the State of Uttar Pradesh and four others, contended that the grievance should be raised through the appropriate administrative channel. The court observed that the petition did not contain a detailed representation and that the correct remedy is to file a fresh representation with the concerned authority. Accordingly, the court disposed of the writ petition while granting the petitioner liberty to approach the respondents afresh with all necessary particulars. The court directed that any representation filed thereafter be considered in accordance with law.
