Holding
The petition is dismissed as the petitioner can seek satisfaction of the award through the Labour Court under the Industrial Disputes Act.
Summary
The petitioner, Prem Pal Singh, filed a writ petition challenging the non‑payment of an amount awarded by the Labour Court on 24 April 2022 in Adjudication Case No. 184 of 2007. The High Court examined whether it could intervene to enforce the award. The Court observed that the petitioner has an alternative remedy by approaching the Labour Court under the provisions of the Industrial Disputes Act for satisfaction of the award. Consequently, the Court found no basis to entertain the writ petition. The petition was therefore disposed without any order directing payment.
Issues considered
- Whether the High Court can entertain a writ petition for enforcement of a Labour Court award when an alternative remedy exists under the Industrial Disputes Act.
