Allahabad High Court

SMT. RANI KUMARIversusSTATE OF U.P. AND 5 OTHERS

Decided

Holding

The Court held that no relief could be granted as the factual disputes required resolution by the appropriate authority, and the petitioner should file a representation for consideration.

Summary

The petitioner, Smt. Rani Kumari, a Silai Teacher, filed a writ petition alleging that she was being paid the salary of a Class‑IV post, which she claimed was improper. The respondents, the State of Uttar Pradesh and others, contested the claim. The Court observed that there were several disputed questions of fact regarding the petitioner’s salary and service conditions. Consequently, the Court found that it could not grant any relief at this stage and directed the petitioner to make a representation to the concerned authority for a first‑instance consideration. The writ petition was therefore disposed of without any order on the merits.

Issues considered

  • Whether the petitioner is entitled to the salary of a Class‑IV post while serving as a Silai Teacher.
  • Whether the Court can grant relief in a writ petition when there are material factual disputes.

                                    2. At this stage, the Court does not find that any relief can be granted to

would be better that a representation be filed by petitioner to raise her

respondent, expeditiously, since on face of it the Court is not convinced

that petitioner while working on the post of Silai Teacher is getting salary

                                    of a Class-IV post.

                                    3. With aforesaid observations, the writ petition is disposed of.
