Allahabad High Court

RAMSAMUJHversusSTATE OF U.P. AND 8 OTHERS

Decided

Holding

The court directed the Deputy Director to decide the pending title revision case within three months, after granting a hearing to the parties.

Summary

The petitioner filed a writ petition seeking a mandamus directing the Deputy Director of Consolidation, Azamgarh, to decide a pending title revision case (Case No.1327 of 2025) filed under Section 48(1) of the U.P. Consolidation of Holdings Act. The petitioner alleged that the case, filed on 22 September 2025, was not being progressed expeditiously. The court, without delving into the merits of the title revision, observed that the administrative authority had failed to decide within the prescribed time. Consequently, the court ordered the Deputy Director to hear the parties and decide the matter within three months of the certified copy of the order. The writ petition was thereafter disposed.

Issues considered

  • Whether the Deputy Director of Consolidation, Azamgarh, failed to decide the pending title revision case within the period prescribed under Section 48(1) of the U.P. Consolidation of Holdings Act.
