Allahabad High Court

MOHD AKHTARversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The Court held that it may issue a mandamus directing the Board of Revenue to decide the pending revision within six months after hearing the parties.

Summary

Petitioner Mohd Akhtar filed a writ petition seeking a mandamus directing the Uttar Pradesh Board of Revenue to decide a pending revision (Rev/563/2025) under Section 210 of the U.P. Revenue Code, 2006. The revision arose from an ex parte order passed under Section 24, against which a recall application was rejected. The petitioner alleged that the revision, pending since February 2025, was being repeatedly adjourned without justification. The Court examined whether it could compel the Board to decide the matter expeditiously. Finding that the delay prejudiced the petitioner’s rights, the Court issued a direction for the Board to pass an appropriate order after hearing all parties within six months. The petition was disposed with this direction.

Issues considered

  • Whether the High Court can issue a mandamus directing the Board of Revenue to decide a pending revision under Section 210 of the U.P. Revenue Code, 2006.
  • Whether the delay and routine adjournments in the revision proceedings justify judicial intervention.
  • Whether the Board of Revenue must decide the revision within a fixed time frame after hearing all parties.
