Allahabad High Court

SHARDA DEVIversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The court held that the petitioner's relief to cancel the consolidation proceedings could not be granted as the necessary forms were filed and the Section 52 notification had already been published.

Summary

Sharda Devi filed a writ petition seeking cancellation of land consolidation proceedings against the State of Uttar Pradesh and others. The petitioner argued that the consolidation process should be halted. The court examined the record and noted that the required CH Form No. 41 and CH Form No. 45, along with the consolidation map, had already been submitted to the archive on 29 September 2025, and a notification under Section 52 was published on 21 November 2025 by the Commissioner of Land Records. Since these procedural steps were completed, the court found that the petitioner’s request to cancel the consolidation was no longer tenable. Consequently, the writ petition was dismissed.
