Allahabad High Court

DHARMVEER SINGHversusSTATE OF U.P. AND 2 OTHERS

Decided

Holding

The petition for cancellation of the consolidation proceedings is dismissed.

Summary

The petitioner, Dharmveer Singh, filed a writ petition seeking the cancellation of consolidation proceedings that were initiated under Section 4 of the Uttar Pradesh Consolidation of Holdings Act, 1953. The High Court had earlier directed the State's standing counsel to obtain instructions, which were filed on 21 August 2026. The instructions revealed that the majority of the villagers supported the consolidation, and the petitioner was the sole objector. Considering the lack of substantive opposition and the instructions indicating community support, the Court found no merit in the petition. Consequently, the writ petition was dismissed.

Issues considered

  • Whether the consolidation proceedings initiated under Section 4 of the U.P. Consolidation of Holdings Act, 1953 can be cancelled on the petitioner's objection
