Allahabad High Court

VIJAYversusSTATE OF U.P. AND 4 OTHERS

Decided

Holding

The Court ordered the Sub Divisional Magistrate to decide the pending case within two months, avoiding unnecessary adjournments.

Summary

The petitioner, Vijay, filed a writ petition seeking an order directing the Sub Divisional Magistrate of Tehsil Kasiya, District Kushinagar, to decide a case (No.T202605440402551) filed under Section 67-A of the U.P. Revenue Code, 2006. The petitioner alleged that despite a considerable lapse of time, no final decision had been rendered. The respondent State of U.P. and other respondents opposed the petition. The Court examined the record and noted the undue delay in adjudication. It directed the Sub Divisional Magistrate to decide the matter strictly in accordance with law, as expeditiously as possible, preferably within two months, and to avoid unnecessary adjournments. The petition was disposed with the relief granted.
