SUKDEVversusSTATE OF U.P. AND 4 OTHERS

Decided

Holding

The Court held that the Sub‑Divisional Magistrate must decide the pending case under Section 67‑A of the U.P. Revenue Code, 2006 promptly, preferably within two months, and refrain from unnecessary adjournments.

Summary

The petitioner, Sukdev, filed a writ petition seeking a direction to the Sub‑Divisional Magistrate of Tehsil Kasiya, District Kushinagar, to decide a pending case (No.T202605440402540) filed under Section 67‑A of the Uttar Pradesh Revenue Code, 2006. The petitioner alleged that despite a considerable lapse of time, no final decision had been rendered. The Court examined the petition and the record, noting the delay in adjudication. It ordered the magistrate to decide the matter strictly in accordance with law, as expeditiously as possible, preferably within two months, and to avoid unnecessary adjournments unless a legal impediment exists. The order was pronounced by Justice Prakash Padia on 18 March 2026, and the petition was disposed.
