Holding
The High Court directed the Sub‑Divisional Magistrate to decide the pending revenue case within two months, without granting unnecessary adjournments unless a legal impediment exists.
Summary
The petitioner, Bahadur, filed a writ petition seeking a direction to the Sub‑Divisional Magistrate of Tehsil Kasiya, District Kushinagar, to decide a revenue matter (Case No. T202605440402538) filed under Section 67‑A of the U.P. Revenue Code, 2006. The petitioner alleged that despite a considerable lapse of time, no final decision had been rendered. The Court examined the record and noted the undue delay in adjudication. It held that the magistrate must decide the case expeditiously, preferably within two months, and should not grant unnecessary adjournments unless a legal impediment exists. Accordingly, the petition was disposed by directing the magistrate to decide the matter strictly in accordance with law within the stipulated period.
Issues considered
- Whether the Sub‑Divisional Magistrate is obligated to decide a revenue case filed under Section 67‑A of the U.P. Revenue Code, 2006 within a reasonable time.
